This requirement applies to all children of the mentioned age regardless of weight.

Also, if a seven-year-old weighs only 37 pounds, or a 3 ½-year-old weighs 42 pounds, he or she should use a federally approved child restraint. It is important to note that under the Maryland child safety seat laws, the term “child safety seat” includes not only infant seats, convertible seats, and forward-facing seats, but also booster seats. The term “federally approved” refers to those seats that fit the size, age and weight of a certain child.

It is further worth noting that those traveling in a vehicle that is registered out of state are still subject to the rules set forth by the Maryland child safety laws, which apply to children under the age of 4, regardless of weight and age. In addition to this, it is maintained by the Maryland child safety seat laws that an adult may not bring and transport a child younger than 16 years of age unless the child is secured in a child safety seat or on a seat belt. Children under this said age are not even allowed to ride in an open cargo bed of a pickup truck.

If, for example, a violation of the Maryland child safety seat laws is noted, the vehicle may be stopped and the driver issued a citation for a violation. Along with this, the driver has to pay a fine. Right now, drivers who bring children but have not restrained the child or allowed the child to ride in an open cargo truck bed are subject to paying $48 to $50 in fines for the violation of the Maryland child safety seat laws.
